Regional Trade Agreements

Regional Trade Agreements provide Malawian exporters with preferential market access through reduced tariffs, harmonised trade rules, and simplified regional trade procedures.

Malawi is a member of regional economic communities that promote intra-African trade through tariff reduction, harmonised customs procedures, and coordinated trade policies. These frameworks provide exporters with preferential access to participating member states, subject to compliance with applicable rules of origin and certification requirements.

1. African Continental Free Trade Area (AfCFTA)

The African Continental Free Trade Area (AfCFTA) is a continent-wide trade agreement aimed at creating a single African market for goods and services. It seeks to progressively eliminate tariffs on at least 90% of goods traded within Africa and reduce non-tariff barriers. Malawi is a State Party to the AfCFTA.

Eligibility Requirements

To qualify for preferential treatment under AfCFTA:

  • Goods must be wholly obtained in Malawi
  • Minimum local content requirements vary by product
  • Meet product-specific Rules of Origin, including minimum value addition or substantial transformation requirements

An AfCFTA Certificate of Origin is required to claim preferential treatment.

Important Note for Exporters

Implementation is ongoing, and tariff schedules and product coverage vary by country. Exporters are advised to confirm:

  • Whether the importing country has operationalised AfCFTA preferences
  • Applicable tariff concessions
  • Product-specific Rules of Origin

2. Common Market for Eastern and Southern Africa (COMESA)

Malawi is a member of the COMESA Free Trade Area (FTA), which provides duty-free or reduced tariff treatment on qualifying goods traded among participating member states.

  • Access to a regional market of over 400 million people
  • Coordinated customs cooperation mechanisms

Eligibility Requirements

Goods must:

  • Be wholly obtained in Malawi (e.g., agricultural produce), or
  • Meet minimum value addition or substantial transformation requirements under COMESA Rules of Origin

3. Southern African Development Community (SADC) Trade Protocol

The SADC Trade Protocol facilitates intra-regional trade through the gradual elimination of tariffs and reduction of non-tariff barriers among member states.

  • Harmonised customs and trade procedures

Eligibility Requirements

Products must:

  • Be wholly produced in Malawi, or
  • Comply with product-specific rules of origin (PSRO), including minimum local content or tariff classification change requirements
